前回までのメルマガではず〜っと日本特許検索を取り上げてきました。

メルマガの説明文で


「特許電子図書館(IPDL)・各国特許庁データベースを
　　　　　　　　　　　　　　　　　　　使った特許検索のコツを解説」


と書いておきながら、日本のIPDLに偏った内容になっていました。今回からは
米国や欧州の特許電子図書館であるUSPTOやesp＠cenetを重点的に取り上げて
いきます。今回から米国特許検索の基礎・基本について解説していきます。

米国特許商標庁(USPTO)のウェブサイトに

というページがあります。米国特許検索を行う際の基本的な7つのステップに
ついて述べています。この7つのステップは米国特許検索だけではなく、日本
特許検索や欧州特許検索などにも共通する部分がありますが、米国特許検索に
特有のステップもあります。

米国特許を調べるためには主に2つの方法があります。


1つは米国の各州にあるPatent and Trademark Depository Library (PTDL) と
呼ばれる特許商標寄託図書館に行って調べる方法です。

もう1つがUSPTOのウェブサイトで調べる方法です。

これから説明する「Seven Step Strategy」は上記2つのいずれの方法にも共通
する検索戦略です。


「Seven Step Strategy」は大きく3つのセクションから成り立っています。


　・Classification　　　　〜分類〜
　・Access Full-Text　　　〜全文にアクセスする〜
　・Review and References 〜公報をレビューする〜


の3つです。以下、順を追って解説していきます。

まず最初のセクションは「分類」を決定する作業です。


※ご存知の方もいるかもしれませんが、米国は独自の分類である米国特許分類
　を採用しています。 IPC(国際特許分類)も採用していますが、その付与精度
　は低いと言われています。

1. Brainstorm keywords related to the purpose, 
　　　　　　　　　　　　　　　　use and composition of the invention.

「発明の目的、利用方法、組成などに関連するキーワードを洗い出す」ことが
第1ステップです。

2. Look up the words in the Index to the U.S. Patent Classification 
　　　　　　　　　　　　　　　　　to find potential class/subclasses.

次に関連する可能性のある米国特許分類クラス・サブクラスを探すために、
第1ステップで洗い出したキーワードを用いて

・Index to the U.S. Patent Classification
　http://www.uspto.gov/go/classification/uspcindex/indextouspc.htm

を探します。この「Index to the U.S. Patent Classification」は技術用語
がアルファベット順に整理されていて、その技術用語に対応する米国特許分類
を調べることができます。


例えば自動車(Automobileまたはvehicle)を調べたいのであれば、Aのところを
クリックして以下の部分を探し当てます。その後、自動車のどの部分の特許を
調べたいのか、関連する分類を選択します。

3. Verify the relevancy of the class/subclasses by using the 
　　　　　　　Classification Schedule in the Manual of Classification.

第2ステップで探した米国特許分類のクラス・サブクラスについて、分類マニュ
アルの中にある「Classification Schedule」で妥当性をチェックします。

4. Read the Classification Definitions to verify the scope of 
　　　　　　　　　　　the subclasses and note "see also" references.

サブクラスの範囲が妥当であるかClassification Definitions(分類定義)を
読みます。また「see also」があれば参照する。

分類の説明文だけでなく、定義文を読んでサブクラスの妥当性を確認します。

5. Search the Issued Patents and the Published Applications databases 
　 by "Current US Classification" and access full-text patents and 
　 published applications.

選択した米国特許分類を利用して米国特許公報へアクセスします。

登録特許を調べたいときは「Issued Patents (PatFT)」を、公開特許を調べた
いときは「Published Applications (AppFT)」のメニューを利用します。


米国特許分類での検索は

・Quick Search
　http://patft.uspto.gov/netahtml/PTO/search-bool.html

・Advanced Search
　http://patft.uspto.gov/netahtml/PTO/search-adv.htm

Quick SearchではTermに選択した米国特許分類を記入して、FieldをCurrent 
US Classificationを選択してSearchボタンを押します。

Advanced SearchではCurrent US Classificationのフィールドコードである
CCLを利用して、Queryのところに「CCL/米国特許分類」と記入します。

　を使ってQuick Search、Advanced Searchで検索してみてください。

6. Review the claims, specifications and drawings of documents

米国特許分類で検索してヒットした特許公報の関連度を決定するために、特許
請求の範囲(クレーム)、明細書、図面を参照します。

7. Check all references and note the "U.S. Cl." and "Field of Search" 
　　　　　　　　　　　areas for additional class/subclasses to search.

全ての公報をチェックして、公報の"U.S.Cl."や"Field of Search"をチェック
して、追加検索する必要があるクラス・サブクラスがないか確認します。
